We might also see more employers imposing clawback provisions for bonuses or withholding deferred compensation where an employee joins a competitor, or even pushing some employees into LLP arrangements to circumvent the limit.
For the time being, employers should ensure that their existing non-compete and other restrictions are up to date and have good prospects of being upheld if tested in the courts as the law currently stands.
