“Whether or not a complaint is found to be eligible within these time limit rules is a matter for the Fos and it would not be appropriate for me to comment on the application of those rules in any individual case,” Afolami concluded.
FT Adviser understands that Shapps has written back to the Treasury, to provide evidence that the lack of the 15 year long-stop was discussed and agreed by parliament.
Shapps said: “I was concerned to hear of my constituent’s experience and it is important that the law is applied fairly in all cases.
"I have written to the chancellor to ask that this might be investigated, as I understand this is an issue which dates back many years and clarity will be helpful for everyone who may be in similar positions.”
At the time of writing, Shapps had not yet received a response back.
